What Previously Certified DBE Firms Need to Know (March 2026 Update)
To recap, the U.S. Department of Transportation (U.S. DOT) issued an Interim Final Rule (IFR) effective October 3, 2025, that changed how Disadvantaged Business Enterprise (DBE) and Airport Concession DBE (ACDBE) eligibility is evaluated nationwide.
The most significant change:
Race‑ and sex‑based presumptions of disadvantage have been removed.
Under the updated rule (49 CFR §26.67), all applicants must now affirmatively demonstrate social and economic disadvantage on a case‑by‑case basis, without relying on presumptions of minority status.
Although this ruling applies nationally, each state implemented its own timeline and re‑evaluation process.
California has now reopened the process for DBE firms to reapply and seek reinstatement under the updated standards.
What This Means for California DBEs
This reevaluation applies to firms that:
- Were previously DBE/ACDBE certified in California
- Are seeking reinstatement under the Reevaluation Requirements.
So if your home state is California, and you were previously certified as a DBE by an agency member of the California Unified Certification Program, you must submit additional documentation to recertify.
At this time, the program is not open to new applicants who were not previously certified DBEs prior to the IFR.

What Will Be Required
To maintain or reinstate DBE/ACDBE eligibility under the new standards, firms will be required to submit:
- A detailed Personal Narrative (PN)
- An updated Personal Net Worth (PNW) statement
- Supporting financial documentation
- Evidence demonstrating continued ownership and control
Owners must demonstrate social and economic disadvantage based on individualized experiences — not presumed status.

What the Personal Narrative Must Address
The Personal Narrative must:
- Describe specific instances of hardship, systemic barriers, or denied opportunities
- Explain when and where those incidents occurred
- Identify who was involved
- Detail how those experiences impeded education, employment, or business advancement
- Clearly connect those impediments to measurable economic harm
The narrative must establish disadvantage by a preponderance of the evidence and will require a signed affirmation under penalty of perjury.

Additional Eligibility Considerations
Eligibility standards regarding ownership and control remain in place.
Firms must continue to demonstrate:
- At least 51% disadvantaged ownership
- Real and substantive operational control
- Independence from nonDBE firms
- Qualification under applicable size standards
Documentation must support the firm’s current structure and operations.

Strategic Consideration
This is not a routine renewal.
The updated standard places significant weight on individualized proof and documentation.
Firms that prepare carefully — particularly thinking carefully about the story their Personal Narrative tells — will be better positioned for successful reinstatement.
